Drunk drivers with no insurance!!

Got rear ended by a drunk driver saturday night. Totalled my car. In fact the driver side rear wheel isnt even attached to the car anymore. The guy was 22, charged with DUI for alcohol and narcotics. Worst part is he has no insurance, was in a rental car because he totalled his truck a month ago in another DUI, and didnt get insurance with enterprise. Medical bills are going to suck and I want to kill this kid.

It's okay, your insurance will pay for it and then they'll sue him. They'll even ask how much your bills were and if you were out of work and any compensation, etc. Tell them you want a few thousand dollars for your inconvenience and they'll just put it on the tab of what they're gonna sue him for. Obviously if he doesn't have insurance and this is his 2nd, he's not gonna have any money but his shit will be garnished for a long ass time unless he gets a job laying bricks for cash.

Problem is I dont have uninsured motorist insurance. So because of that, apparantly my insurance company isnt liable either. Total bullshit.

You may want to contact the Rental Car Company that rented him the car. He may have bought Rental Car Insurance from them which would cover you. Even if he didn't most states require that all rental car companies carry the State minimum in liability insurance on their vehicles for these such cases. I used to operate a rental car company as a franchise back in AZ. Back there the company had to had to have a 25K amount of liability insurance on the car as it was state law. So you should be covered at least up to that amount. That is why Rental Car Companies require Credit Cards when you rent it for these cases, so basically they cover you and your damage and then they have to pay foe their own car and then they just usually end up putting the whole tab on the idiots Credit Card or suing him. You should check with a lawyer about it first. Most states require the owner keep insurance and if the person driving is not licensed or doesn't have insurance... the owner of the vehicle is responsible.

Tough way to learn how important uninsured motorist coverage is.

I agree, wish I had even known what that was before now. I will definitely be covered when I do get a new vehicle.

Yeah, but along with what Deviant Z said, the rental company in most places HAS to carry insurance on their cars. That's what you are actually buying when you pay for the added rental insurance is their insurance that's already on the car. If you look into it, I bet you can get your stuff paid for.
